Terms of Service

These Terms of Service ("Terms") govern your access to and use of Wingman ("Service"), an AI-powered sales productivity platform operated at wingman.zone. Wingman is a product of NomadxLabs ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Service Description
Wingman is an AI-powered sales co-pilot that helps sales professionals automate CRM updates, generate call analysis, draft follow-up emails, and track deal progress. The Service integrates with third-party platforms including HubSpot CRM and Gmail via user-authorized OAuth connections.
2. Account Terms
- You must be at least 16 years old to use Wingman.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate and complete information when creating your account.
- One person or legal entity may not maintain more than one free account.
- You may not use Wingman for any illegal purpose or in violation of any laws.
3. Payment and Billing
Subscriptions
Wingman offers paid subscription plans (Solo, Pro, Business, Team) billed monthly. Prices are listed on the pricing page and may change with 30 days notice to existing subscribers.
Free Trial
New accounts receive 3 free call analyses. No credit card is required for the free tier. To access additional analyses, a paid plan is required.
Billing Cycle
Subscriptions are billed monthly on the anniversary of your subscription date. All payments are processed securely by Stripe.
Cancellation
You may cancel your subscription at any time from the Settings → Billing page. Upon cancellation, your plan remains active until the end of the current billing period. You will not be charged for subsequent periods.
Refunds
We offer a 7-day refund on new subscriptions if you contact us at support@nomadxlabs.com within 7 days of your first charge. Subsequent billing periods are non-refundable. Refunds are issued to the original payment method within 5–10 business days.
4. Acceptable Use
You agree not to:
- Upload call recordings or transcripts without the knowledge and consent of all parties
- Use the Service to send spam, unsolicited communications, or harass others
- Attempt to reverse engineer, scrape, or extract data from the Service
- Share your account credentials or resell access to the Service
- Use the Service in any manner that could impair or overburden our infrastructure
- Upload content that is illegal, defamatory, or violates any third-party rights
- Use the Service to violate any applicable laws or regulations
- Use the Service to impersonate any person or entity, or create synthetic or fraudulent identities
- Abuse the API through automated scripts, bots, or any method designed to circumvent rate limits or usage quotas
- Use the Service to facilitate fraud, phishing, social engineering, or any form of deceptive practice
- Attempt to gain unauthorized access to other users' accounts, data, or connected integrations
We reserve the right to suspend or terminate accounts that violate these terms.
NomadxLabs reserves the right to immediately suspend accounts that exhibit suspicious activity, risk signals, or patterns consistent with fraud — even in the absence of a confirmed Terms violation. We will notify affected users promptly and provide an opportunity to appeal.
5. Intellectual Property
Your Content: You retain all ownership rights to call recordings, transcripts, CRM data, and any other content you upload to or create through Wingman ("User Content"). By using the Service, you grant NomadxLabs a limited, non-exclusive, revocable license to process your User Content solely for the purpose of providing, maintaining, and improving the Service for you. This license terminates when you delete your content or close your account. We do not claim any ownership interest in your User Content.
Our Service: Wingman, including its software, AI models, user interface, and documentation, is owned by NomadxLabs and protected by copyright, trademark, and other intellectual property laws.
AI Outputs: Analysis, summaries, and email drafts generated by Wingman are provided for your use. We do not claim ownership of AI-generated outputs derived from your content.
No Training on Your Data: NomadxLabs does not use your call recordings, transcripts, analysis results, or any other user-generated content to train, fine-tune, or improve AI or machine learning models. Your data is processed solely to deliver the Service to you and is never used for any other purpose.
6. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOMADXLABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO NOMADXLABS FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
7. Service Availability
No Service Level Agreement: Wingman is provided without a formal Service Level Agreement (SLA). While we strive for high availability and reliability, we do not guarantee specific uptime percentages, response times, or support turnaround times. We will make commercially reasonable efforts to maintain service availability.
Planned Maintenance: We may perform scheduled maintenance that temporarily affects service availability. Where possible, we will provide advance notice of planned maintenance via email or in-app notification.
Beta Features: From time to time, we may offer beta or experimental features. These features are provided "as is" without any warranty, may change or be discontinued without notice, and may not be covered by our standard support. Use of beta features is at your own risk.
8. Termination
By you: You may terminate your account at any time by cancelling your subscription and deleting your account from Settings.
By us: We may suspend or terminate your account immediately if you violate these Terms, if required by law, or if we discontinue the Service with 30 days notice to active subscribers.
Upon termination, your data will be retained for 30 days during which you may request an export. After 30 days, your data will be permanently deleted.
9. Third-Party Integrations
Wingman integrates with third-party services (HubSpot, Gmail, Stripe) via OAuth. Your use of these integrations is subject to the terms of those third-party services. We are not responsible for the actions, content, or policies of third-party services.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Changes to Terms
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days notice via email to registered users. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey and the United States, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in the State of New Jersey. The arbitrator's decision shall be final and binding.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against NomadxLabs. Claims must be brought on an individual basis only. Nothing in this section prevents either party from seeking injunctive or equitable relief from a court of competent jurisdiction.
